FCRA Rights & Credit Disputes
What is the FCRA?
The Fair Credit Reporting Act (15 U.S.C. § 1681) is a federal law that promotes the accuracy, fairness, and privacy of consumer information in the files of consumer reporting agencies (credit bureaus). It gives you specific rights to dispute inaccurate information and hold bureaus accountable.
What can I dispute on my credit report?
You can dispute any information on your credit report that you believe is inaccurate, incomplete, or unverifiable. This includes incorrect account balances, accounts that don't belong to you, incorrect payment history, wrong dates, and accounts resulting from identity theft.
What is a Section 609 dispute?
Section 609 of the FCRA gives you the right to request disclosure of all information in your consumer file. A 609 letter requests that the credit bureau provide you with verification of the accounts listed on your report, including the original source of the information.
What is a Section 611 dispute?
Section 611 of the FCRA requires credit bureaus to investigate disputes within 30 days (or 45 days if you provide additional information during the investigation). If the bureau cannot verify the disputed information, it must be removed from your report.
What is a Section 623 dispute?
Section 623 allows you to dispute directly with the data furnisher (the company that reported the information to the credit bureau). After you have first disputed with the bureau, you can send a direct dispute to the furnisher requiring them to investigate.
What is a Section 605B dispute?
Section 605B provides protections for identity theft victims. If you are a victim of identity theft, you can request that the credit bureau block the fraudulent information from appearing on your report. You will typically need to provide an identity theft report.
How long does a credit bureau have to respond?
Under FCRA Section 611(a)(1), a credit bureau must complete its investigation within 30 days of receiving your dispute. This can be extended to 45 days if you submit additional relevant information during the investigation period.
What happens if the bureau doesn't respond in time?
If a credit bureau fails to complete its investigation within the required timeframe, it must delete the disputed information from your report. You may also have grounds to file a complaint with the Consumer Financial Protection Bureau (CFPB) or pursue legal remedies.
